Federal Government to Prosecute Chino Valley Medical Center

The National Labor Relations Board (NLRB) will prosecute multiple Unfair Labor Practices (ULPs) against Chino Valley Medical Center in a trial beginning June 6.

UNAC/UHCP filed the ULP charges in May and June 2010. The NLRB conducted a neutral investigation and found nearly all of them meritorious. It filed a Consolidated Complaint on the charges February 25, 2011.

Charges that the NLRB will prosecute against the Hospital include: unlawfully firing Ron Magsino; refusing to provide information necessary for bargaining; threatening new rules and tighter enforcement of existing rules if nurses voted to join the union; interrogating nurses about union activities; disciplining nurses because of protected union activity; and denying union representation in investigatory meetings.

The Hospital’s violations are considered so severe that the NLRB is seeking an extraordinary remedy: CEO Dr. Lex Reddy or another high-ranking executive to read the Notice of Unfair Labor Practices aloud to nurses on worktime.

The NLRB also seeks to rescind the unilateral changes, restore benefits, and remove retaliatory discipline from nurses’ personnel files.
